When I entered the US on H1B, the officer at the airport stamped my I-94 for the day my passport expires (dec 2005). I am in the process of renewing my passport and wish to extend my I-94 also. Has anybody done this before? What is required? how long does it take?

I have done this process (you can mail me for specifics). For change of status / extention you don't have to leave the country. You will get a new I-94 with the approval of the *new* application. But the next time you DO leave the country, you will have to go back to the country of your origin and get a new visa with biometric information.

I also think for H extentions your employer will have to file a new LCA.

hope this helps.

I am also looking for answer to Eliza's question. This is NOT extention of I-94 or change of status. The visa is valid but I-94 expires just because passport expires. Anyone had this situation, please let us know how they obtained new I-94.

Pavi: In any case the I-94 date stamped in the passport will expire and hence it will be treated as end of lawful stay in US and an I-94 extension needs to be filed and not visa extension. Please follow the links above for more information. I believe that one will have to file for I-94 extension, unless they have extended their visa and have got the approval notice which will have I-94 attached to it. I would suggest take lawyers suggestion or
ask an expert here...
