Hi, I came to US on F1 but now I need to change my status to H4 for about 6 months after which I will be going back to F1. How easy or difficult is this going to be? Will I have to go back to India for getting my Visa stamped? Priya.

Priya: Attempt to answer your Q. 1. How easy or difficult is this going to be? A. It wont be easy considering processing times and hassels. 2. Will I have to go back to India for getting my Visa stamped? A. Yes, you will have to go to your home country if visa status changes in order to get the new visa stamped in your passport. Few things you might want to consider: 1. If current F1 visa will be valid long enough before you apply for new/extended F1 visa then you might not want to do anything for now and just make one trip to India when you get a new F1. 2. If you are going out of status cause your current F1 expires then you do not have an option but either to enjoy 6 mths vacation in India and wait for new F1 visa or get H4 visa. In any case you will have to go to India for stamping purposes. 3. You might as well get the new F1 now! I hope this helps... P.S. I would confirm above situations from an eligible attorney to avoid any confusion.

Thank you so much, Yogibear, for your quick response. Little more information regarding the same. My F1 is valid for 5 more years but I do not like the university I am currently attending. So want to change it. But new sessions begin in September. Hence all the hassle. Any ideas about what I should ideally be doing? Care, Priya.

Try to find a school where application deadline for spring 2005 session hasn't passed and apply there. If not, hang in whereever you are and apply for Fall 2005.

Khan: you said it. Priya: Since in your case, current F1 is valid till you get the new F1 approval (which might be fall 2005), You may not want to do anything for now as you are not "out of status". But be sure to verify that your current University does not cancel your current F1 or notify about it to INS, in which case you will be forced to take some action mentioned above in order to remain "in status". I hope this clarifies, but again an advice from an attorney is always the best approach.... Good Luck!!!

if i am not wrong : fall 2004 : current sem : you are "in status" spring 2005 : if your current univ. is not costly and you have fee waiver or so, .... be "in status" . you can opt for thesis/ independent study or project courses and not attend the school or whatever summer 2005 : optional .... you dont have to register and you are still "in status" fall 2005: 1. register to be "in status" 2. get i-20 from new univ. 3. make i-20 transfer september is not bad for doing this as final deadline for being out of status for currnt univ. is not been reached yet. 4. you can stay here till your i-20 is transferred ( in between). this is just my point of view. .... rest is your decision. good luck

Hi Madhura, You kind of got the picture...my univ is terribly expensive and that is one of the reasons for dropping out. but your idea seems great..had never thought of summer 2005 option. Thanks
