Thanks Swati and Shubhaji,

One more thing is that our office people say that while giving H4 visa, the US embassy people ask for a Phoho Album of marriage , but I am thinking of going for registered marriage and there wont be any grand ceremony to show in the photographs. Will such photographs be acceptable ?

My marriage was also a registered marriage. We had some family photographs in front of registrar office with bonquets in our hands.
I showed the same photos when officer asked me. I explained him that it was not a 'Hindu' marriage.
He remarked " It seems to be different" but I had no problems getting my visa.
Important thing is marriage certificate. You should carry your photos though.

My wife has also not changed her maiden name after
marriage.I went to US on H4. we had no problems.
I think u will have to get your marital status changed on the passport.

I wasn't asked to produce marriage photos at all. We also had a register marriage. This may not be of any help to you. We have a daughter. The only questions asked were due to difference in her last name and mine; as she was comming as my dependant.

Hi to all,
I am Mugdha from Pune. I am also sailing in the same boat as I am on H4. Currently I am in Manchester, New Hampshire. I came in USA in July-2000. I used to work as s/w developer in pune. Now here I am not able to get job due to my visa status. I don't know what to do?
I want some information about this.

Try to get a employer who is ready to change your visa status ( though the process takes some more time ). There are some around. Keep on trying. Best of Luck.

I don't know if this question is asked b4 or not.

Is it legal to work if one has applied for H1 visa and received a WAC number (receipt from INS) but not yet received approved visa. I suppose it is not legal because there are lot of complications. E.g. till one's status is not changed from H4 to say H1, he/she does not get SSN. So no bank account. So where does that person's payment goes? Also no tax is payed directly by the employer since no SSN. If the money is saved in spouse' account, it can be construed as black money. Anybody has any knowledge abt this issue?

Yes you r right. As status is not changed from H4 to H1, H4 person can not work. As per new rules, H1 to H1 can work on WAC Number but not for H4 to H1.

u start working in the company, company will not pay u money . when u get H1 company will give all amount as a signing bonus

offcourse if u and ur company agrees to it.

again i don't know if it is legal or not

This is a mutual arrangement, but still not legal, I suppose. If it is my bad luck, that INS raid case can happen again and I might end up in jail.

Shailesh, the new change is applicable only for h1-h1 transfer & not for a new h1. When you are getting h4 - h1 transfer, it's again a new h1.

and i think this can be legal. bcoz, the person can work as an intern or something. why would INS raid ur house for this ? ;)

of course, there has to be proper understanding between both; else if u dont get anything as signing bonus, u cant claim that money.

Without waiting for H1 if you start working,
you are depriving an american of one job. You
are an outsider. You MUST have a legal authorization before you do any work.
That's why it is illegal. Even if the employer
and employee are happy about this arrangement,
INS will not be happy. Also what if that H1 got
rejected for some reason? In that case you have been working illegally.

Working without pay is illegal for an immigrant (H1B or H4).
That also deprives an american of a job.
That's why H1/H4 people are (legally) not allowed to do any voluntary work! I read this on a lawyer's web page.

I think it was Sheila Murthy's page. Although it
may look odd at first, but if a nonimmigrant visa holder does a voluntary work, say in a library,
one citizen loses an opportunity to earn his livelihood. An H1 holder is allowed ONLY to work
for the company he has stated in the legal
paper. H4 is not allowed to work AT ALL.
All this is speaking legally. The reality may
be different.

You line in Manchester, NH. I'm not sure if you've found an employer, but try a "desi" co first. No doubt they will pay you less with no benefits but once you get your H1, it will be very easy to transfer to a better job. The H1 transfer too can be done overnight.

There are a few "good" ( ? ) desi companies around NH, in Boston..did you try them ? I know of one company who might be able to help you.

Well this is oe of teh very popular myth. It is easy but as easy as it sounds. According to INS, it takes 60 working days if you are doing H1 transfer and then 60 working days to get H1 stamping using post. However there are cases that later has been achieved in 8 days, but those are rare cases. New law has made things little easier but I always advice to be cautious in this matter.

H1-B transfer if done thru premium processing ($1000 more), INS has to complete cases within 15 days, unless INS needs to send a request for additional information. In that case, presumably INS will send that request (Request for Evidence, or RFE) within 15 days.
Most people i know have got it as an average in 7 days. But that doesnt mean INS is obliged to do that. As long as they send reply in 15 days they have done their job.
